Short Description

Public consultation has commenced on new draft regulations under Australia’s Biosecurity Act 2015.

The Australian Government, through the Department of Agriculture and Water Resources, has released further draft regulations under Australia’s new Biosecurity Act 2015 for public consideration. These documents provide additional detail for those who will be regulated by the biosecurity legislation.

The following draft regulations were published on the department’s website on 10 March 2016. • Biosecurity (Cost Recovery) Regulation 2016 • Biosecurity Charges Imposition (General) Regulation 2016 • Biosecurity Charges Imposition (Customs) Regulation 2016 Consultation is open until 24 March 2016.

In December 2015, the department released new cost recovery arrangements through the Cost Recovery Implementation Statement 2015 – 16. These three pieces of draft regulation transition those same fees and charges from the quarantine charging framework to a similar framework under the Biosecurity Act. These regulations will not result in adjustments to fees.

The Biosecurity (Cost Recovery) Regulation 2016 prescribes fees that may be charged for biosecurity activities, and payment of cost recovery charges.

The Biosecurity Charges Imposition (General) Regulation 2016 prescribes the charges for certain matters connected with the administration of the Biosecurity Act, and exemptions from the prescribed charges.

The Biosecurity Charges Imposition (Customs) Regulation 2016 prescribes charges and exemptions to the extent that the charges are duties of customs.

The release of the draft regulations gives interested clients, stakeholders and trading partners an opportunity to provide feedback on how they will work in practice when the new Act takes effect on 16 June 2016.
