Competent authorities

Competent authorities for phytosanitary sector in BiH are determined by the state-level Law on Plant Health Protection, and include: the Council of Ministers of BiH, BiH Plant Health Protection Administration, Ministry of Agriculture, Forestry and Water Management of the Republic of Srpska, the Republic Administration for Inspection Affairs, the Federal Ministry of Agriculture, Water Management and Forestry, Federal Administration for Inspection Affairs, Department for Agriculture, Forestry and Water Management of the Brčko District of BiH and Inspectorate of the Brčko District of BiH.

Administration of Bosnia and Herzegovina for Plant Health Protection (PHPO)

BiH Administration for Plant Health Protection (PHPO) is an administrative organisation within the Ministry of Foreign Trade and Economic Relations (MoFTER), established by the Decision to Establish the BiH Administration for Plant Health Protection (BiH Official Gazette, no. 23/04) on the basis of the Plant Health Protection Law (BiH Official Gazette, no. 23/03). The Plant Health Protection Law is harmonised with the International Plant Protection Convention - IPPC that was ratified by the Decision to Ratify the International Plant Protection Convention (BiH Official Gazette, International Agreements, no. 8/03). The ratification of the International Plant Protection Convention obliges Bosnia and Herzegovina to establish a national plant health protection organisation.Apart from the legal framework outlined in the Decision on establishment, the PHPO legal framework also includes:

  1. Plant Health Protection Law (BiH Official Gazette, no. 23/03);
  2. Law on Agricultural Seeds and Propagating Material of Bosnia and Herzegovina (BiH Official Gazette, no. 3/05);
  3. Law on Protection of New Plant Varieties in Bosnia and Herzegovina (BiH Official Gazette, no. 14/10 and 32/13);
  4. Law on Mineral Fertilisers (BiH Official Gazette, no. 46/04 and 76/11);
  5. Law on Phytopharmaceutical Products of BiH (BiH Official Gazette, no. 49/04);
  6. The PHPO has partial responsibility as regards the Law on Genetically Modified Organisms (Article 3 Paragraph (2) Item c), Sup-item 2)), (BiH Official Gazette, no. 23/09).

    PHPO is a central body in charge for plant health protection and information exchange with Official International bodies.

The PHPO is the central authority for plant health protection in BiH and for exchange of information with the official international authorities. The PHPO performs administrative and related technical tasks in line with the Plant Health Protection Law and other substantive regulations that make up the legal framework. The PHPO cooperates, informs and exchanges information with the official international plant protection authorities and organisations (EU, EPPO, WTO, FAO, IPPC, UPOV, etc.). Based on substantive regulations, phytosanitary competences are shared between the PHPO and competent entity and BiH Brcko district authorities.
