Short Description

New legislation on phytosanitary measures for the introduction of plants and plant products presenting an unacceptable risk of harmful organisms which will come into force on January 1, 2024, is harmonized with Implementing Regulation (EU) 2018/2019 of 18 December 2018 establishing a provisional list of high-risk plants, plant products or other objects, within the meaning of Article 42 of Regulation (EU) 2016/2031 and with Commission Implementing Regulation (EU) 2020/1213 of 21 August 2020 concerning the phytosanitary measures for the introduction into the Union of certain plants, plant products and other objects which have been removed from the Annex to Implementing Regulation (EU) 2018/2019. Import of plants and plant products from a particular country, or group of countries of origin, or certain areas of those countries, whose introduction into Montenegro poses an unacceptable risk of harmful organisms, shall be prohibited until a risk assessment is carried out. The risk assessment is carried out on the basis of a risk analysis published by the European Food Safety Authority (EFSA), at the request of the European Commission. The plants, plant products and other objects that are considered high risk plants are listed in Annex I of the Rulebook on phytosanitary measures for the introduction of plants and plant products presenting an unacceptable risk of harmful organisms. Annex I is harmonized with Annex of the Regulation (EU) 2018/2019 with amendments Regulation (EU) 2020/1214, Regulation (EU) 2020/1361, Regulation (EU) 2021/1936, Regulation (EU) 2022/490, Regulation (EU) 2022/230, Regulation (EU) 2022/1309, Regulation (EU) 2022/1404 and Regulation (EU) 2023/158. The prohibition does not apply to plants originating from EU Member States and from CEFTA Parties. Annex II is harmonized with Annex of the Regulation (EU) 2020/1213 with amendments Regulation (EU) 2021/419, Regulation (EU) 2021/1936 and Regulation (EU) 2022/490.
